My boss wants to pay me less than the award rate in return for some time off that I get - is this legal? Paul, Burwood |
No. There's a fundamental piece of Industrial law that says employers cannot contract out an award. This means that your boss can't pay you anything less than the minimum rate specified in your award.
Awards are legal documents and if the conditions set out in them aren't met by the employer then this is a breach of the law and just like any other breach of the law can attract a penalty like a fine.
