The Long Service Leave Act in NSW sets out the minimum conditions. Your award or agreement may provide the same or better entitlements. Building and construction industry workers have conditions set out in separate legislation.
Basically all employees are entitled to two months leave on ordinary pay after ten years continuous service with an employer. After that the entitlement is to one month's paid leave foe each additional years' service. Part-time employees are entitled to long service leave on a pro rata basis. Casual employees are entitled to long service if continuous service can be established. Employees may be entitled to a pro rata payment on termination if they have between five and ten years service.
