Probably. The Act (s 4(2)(a)(iii)) allows for a proportionate amount of LSL to be taken after 5 years service when service is terminated by the employer for any reason other than misconduct, or where employment is terminated by the worker on account of illness, incapacity or domestic or other pressing necessity, or because of the death of the employee.
