I am not sure if you can help with advice regarding the right of employers to make specific stipulations regarding the taking of annual leave, but any guidance or direction you can give would be most appreciated: direction as to the length of leave taken, and times when specific periods of leave must be taken (I have another circular stipulating that employees must take a minimum of 2.5 weeks over the Christmas period) are laid out as well as stating that applications for a single days leave wi Greg |

Its a bit of a grey area but if the company actually closes down over the Christmas period then the can require you to take that time as annual leave. Under the NSW Annual Holidays Act that is the only basis for them directing the time you can take leave. Otherwise it has to be a t mutually convenient times with plenty of notice given. The Act also currently states things about the length of leave periods, I think restricting the number of periods to two or three of not less than a week but this is soon to be amended to allow more short term leave. Its fairly short. Employers can get particular abour single days of annual leave, but most don't.
