What The Proposed Package Means For Workers
- The Workers Compensation Resolution Service (WCRS) will be replaced by a Claims Assessment Service.
- Commissioners will determine all matters.
- The effect of this will limit the role of the Workers Compensation Court. The Compensation Court will have very little, if any, input into determining any matters.
- The Service will resolve all disputes over statutory claims as well as assessing damages at Common Law where fault is not an issue. This will be a paper assessment service, i.e. the Commissioner will receive a file only and the matter will be determined behind closed doors.
- The worker will not have the right to give evidence or be heard.
- There will be no right of appeal to the compensation court, except for complex matters of Law.
- A workers ongoing weekly benefit will be determined through the Claims Assessment Service rather than the Workers Compensation Court.
- The Claims Assessment Service is modelled on the Motor Accident Authority Scheme.
- Of all motor accidents that have occurred between since 5th October 1999 and, the 28th March 2001, only one matter has been determined by the Claims Assessment Service.
