What basic entitlements do I have?

Your rate of pay and most of your conditions are detailed in the award and if one exists, the enterprise agreement that covers you. Leave entitlements and other basic conditions and rights are also covered by state and federal industrial legislation.

Most people are entitled to 4 weeks annual leave, one weeks paid sick leave, long service leave after a qualifying period (varies from 5 to 10 years), unpaid maternity leave, at least a weeks notice of termination of employment or pay in lieu of notice, payment for certain public holidays and basic redundancy pay. Casuals may be entitled to some of these entitlements.

Part-time workers (anyone less than full-time) in most circumstances have the same entitlement as full-time workers except that they are paid on a pro-rata basis eg. a worker who works half time is entitled to 50 per cent of the entitlement.

In most cases a worker who works 20 hours a week would still be entitled to 4 weeks annual leave and would be paid at 20 hours per week for four weeks.
